Terms of Use
Purpose
These terms of use (the "Terms") govern access to and use of the Blitz Shopping service, whether that use is free or paid.
The sale of annual access is governed by separate terms, the terms of sale, which apply alongside these Terms. Where the two documents conflict on a matter concerning the sale, the terms of sale prevail.
Acceptance
These Terms bind the User when they have been brought to the User's attention and accepted, under Article 1119 of the French Civil Code. The User may stop using the service at any time.
Access to the service
Using Blitz Shopping requires a valid Telegram account.
The service is open to persons aged fifteen or over, subject to Telegram’s age requirements. In the European Union, Telegram requires users to be at least eighteen to sign up. Any paid order additionally requires legal capacity to contract.
There is no sign-up, no password and no account to create: the User's Telegram identifier is enough to recognise them.
Service
Blitz Shopping provides personal and shared shopping lists in Telegram.
Access conditions
Occasional use of personal lists is free. Regular use starts a free period of 2 months from notification of its commencement. Beyond this period, adding items requires paid annual access. Sharing requires that access from its first use.
Content
The User retains their rights over stored content. The publisher has only the storage and display rights necessary to provide the service.
Use of the service
Deliberate disruption of the service and unauthorised access to other users' data are prohibited.
Availability
Maintenance, updates or technical incidents may interrupt the service. Access also depends on Telegram and the User's internet connection.
These circumstances do not remove the publisher's obligations, statutory guarantees or the User's remedies. For paid annual access, the terms of sale specify the applicable rights.
Changes to the service
Updates necessary to maintain conformity are supplied under Articles L. 224-25-24 and L. 224-25-25 of the French Consumer Code. Other changes are subject to Article L. 224-25-26, including contractual justification, advance information on a durable medium, no additional cost and consumer rights where access to or use of the service is adversely affected.
This clause does not permit unrestricted removal of a purchased feature or limit statutory remedies to a pro-rata refund.
Personal data
The publisher is the controller within the meaning of Regulation (EU) 2016/679 ("GDPR").
What is collected
The service uses the data below to operate lists. Purchasing through Stripe also involves identification, contact and billing data needed for payment and invoicing.
| Data | Why |
|---|---|
| The User's numeric Telegram identifier | to recognise the person and attach their annual access |
| The numeric identifier of the conversation | to attach a list to the conversation it lives in |
| The language declared by Telegram | to reply in the User's language |
| The text of items and the names of lists | this is the service itself |
| Usage timestamps | to measure how regular use is, and trigger the ask and reminders |
| The parameters announced to the User | to prove what was promised if it is ever disputed |
| Annual access start and end dates, and a customer reference from the payment provider | to manage annual access |
Card details are entered with Stripe and are not stored in the bot. Cloudflare's website hosting involves processing connection data, including IP addresses, to route and secure requests.
Legal bases
Performance of the contract for keeping lists, determining the free period and managing annual access; the publisher's legitimate interest in service security; legal obligation for retaining accounting records.
Recipients
Data is accessible to the publisher and providers needed to operate the service: the bot's host, Cloudflare for the website and Stripe for payments. Telegram processes communications on its platform. The publisher does not disclose data to third parties for advertising.
Retention
List and usage data is kept for as long as the User uses the service, and erased on request. Accounting records relating to a payment are kept for ten years, under article L. 123-22 of the French Commercial Code.
The User's rights
Subject to the conditions set by the GDPR, the User may request access, rectification, erasure or restriction of processing. Portability applies to automated processing based on contract or consent; the right to object applies in particular to processing based on legitimate interests.
Requests should be sent to [email protected], with information identifying the account. Further information may be requested where there is reasonable doubt about identity. A response is provided within one month, extendable by two months under Article 12 of the GDPR, with notice during the first month.
Erasure does not override statutory retention obligations or other people's rights. The User may complain to the French data protection authority, the CNIL.
Transfers outside the European Union
Cloudflare, Stripe and Telegram describe international processing in their privacy policies: Cloudflare, Stripe and Telegram. An absence of all transfers outside the European Union is therefore not guaranteed. These policies do not replace the publisher's obligations under the GDPR.
Language preference
The website does not use cookies. Your chosen language is saved in your browser’s local storage. It is kept until you clear the website’s data in your browser and is not used for advertising tracking.
Intellectual property
The service, its name, its source code, its interface and its texts remain the exclusive property of the publisher. The Terms grant the User only a personal, non-exclusive, non-transferable right of use, for as long as they use it.
Suspension and termination
By the User. The User stops using the service whenever they wish, by removing Blitz Shopping from their conversations. No formality is required. For a User with annual access, the financial consequences are governed by the terms of sale.
By the publisher. Where the Terms are breached, the publisher may suspend access and then end it, after a formal notice left unremedied for eight days, save in cases of urgency or manifest seriousness. The consequences for a User with annual access are governed by the terms of sale.
Liability
The publisher is liable as of right for proper performance of a distance contract with a consumer under Article L. 221-15 of the French Consumer Code.
The publisher may be relieved of all or part of that liability only by proving that non-performance or improper performance is attributable to the User, to the unforeseeable and insurmountable act of a third party unconnected with the contract, or to force majeure. A Telegram outage or loss of data does not, by itself, establish an exemption.
These Terms do not limit mandatory consumer rights, including statutory guarantees and the right to compensation.
Complaints and mediation
Any complaint should be sent to [email protected].
Under the provisions of the French Consumer Code concerning consumer dispute mediation, after contacting us and if you have not received a satisfactory response, you may use a consumer mediation procedure free of charge through:

Changes to the Terms
The date from which this version applies appears at the beginning of the document. A new version is brought to the User's attention before it applies and submitted for acceptance where consent is required. Posting it online does not automatically amend an existing contract.
Rights under existing annual access and parameters already announced to the User remain applicable, subject to mandatory law.
Governing law and jurisdiction
The Terms are governed by French law.
A User who is a consumer keeps the benefit of the mandatory provisions of the law of their habitual residence within the European Union, under article 6 of Regulation (EC) No 593/2008.
Failing an amicable settlement, any dispute falls to the courts having jurisdiction under the ordinary rules, a User who is a consumer being free to choose the court of the place where they lived when the contract was formed or when the harmful event occurred.
